"No Limit Look Back" Rule and Felony DWI Charges

A third or subsequent DWI is more than likely going to result in a felony DWI charge. Now, there is no time limit to how long a DWI conviction will count toward new charges. Previously, after a certain time period, a DWI conviction would not be counted toward a new charge. A charge from 30 years ago can now affect your record.

In addition to the "no limit look back" rule, additional rules have been implemented regarding Breathalyzer tests. If an individual refuses a breath test, he or she can be forcibly ordered (without a warrant or judge's order) to be taken to the hospital for a blood test. This is a very recent change that can have a drastic effect on your situation if you are pulled over for suspicion of DWI.
